§ 5-26. Auction on streets; permit required, exception.

  • (a)

    It shall be unlawful for any person to offer for sale at auction, or sell at auction or to the highest bidder, any goods, wares, merchandise, or thing of value on any of the sidewalks, streets or highways of the city without first obtaining a permit in writing from the city. Such permit, if for good reasons shown shall be granted, shall set out the place at which said auction may be had.

    (b)

    This section shall apply to offer for sale, or sales made at public outcry by licensed auctioneers, provided, that same shall not apply to foreclosure sales under mortgage, judicial sales or sales made under the order or decree of any court or by the officers of any court acting under the orders thereof.
