§ 5-106. Hours of sale.

  • (a)

    That on or after the effective date of this section it shall be unlawful for any business establishment, lounge, restaurant, private club, either class I or class II, or any other establishment authorized to sell alcoholic beverages as defined in Sections 28-3A-1 through 28-3A-26 and Sections 28-3-1 through 28-3-86, Code of Alabama, 1975 as amended, to sell, deliver, give away, dispense, or barter any type of alcoholic beverages as defined in the above referred to Code Sections of the Code of Alabama, 1975 as amended, to any person, firm, corporation, partnership or any other legal entity between the hours of 2:00 a.m. on Sunday until 12:00 p.m. on Sunday.

    (b)

    That on or after the effective date of this section it shall be unlawful for any business establishment, lounge, restaurant, private club, either class I or class II, or any other establishment authorized to sell alcoholic beverages for on-premises consumption in the City of Tuscumbia, as defined in Sections 28-3A-1 through 28-3A-26 and Sections 26-3-1 through 28-3-286, Code of Alabama, 1975 as amended, to sell, deliver, give away, dispense, or barter any type of alcoholic beverages as defined in the above referred to Code Sections of the Code of Alabama, 1975 as amended, to any person, firm, corporation, partnership or any other legal entity between the hours of 2:00 a.m. until 6:00 a.m., Monday through Saturday of each week and between the hours of 2:00 a.m. on Sunday until 12:00 p.m. on Sunday of each week.

    (c)

    That the private club liquor license and club liquor license either club liquor license I or club liquor license II heretofore established by the license schedule and ordinances regulating and controlling the sale and dispensing of alcoholic beverages in the City of Tuscumbia is hereby deleted and no such licenses shall hereafter be issued by the City of Tuscumbia.

    (d)

    Any person, firm or corporation or business establishment which violates this section or allows this section to be violated shall have their license suspended by the City of Tuscumbia and they shall forfeit all rights to operate any type of establishment authorized to sell or dispense alcoholic beverages heretofore authorized under the ordinances of the City of Tuscumbia, Alabama as heretofore adopted.

    (e)

    Any person, firm corporation, or partnership which violates this section or allows the same to be violated by any employee shall be subject to a fine of not less than five hundred dollars ($500.00) and imprisonment in the city jail for a term of not less than thirty (30) days nor more than one (1) year.
